Is Kratom Legal?

The answer is both yes and no. Kratom is uncontrolled in the United States. That means that on a Federal level every part of the plant and its extracts are legal to cultivate, buy, possess, have and distribute. “Distribute” means sell, trade or give without a license or prescription. If kratom is sold as a supplement, the sales have to conform to U.S. supplement laws. If its sold for consumption as a food or a drug, sales are regulated by the FDA.
What makes kratom illegal if its Federally unregulated? Kratom has gained attention in certain states. Indiana has banned all sales of kratom. Louisiana has banned the sale of kratom to minors, and is illegal for human consumption. Kratom distributors label all their product “not for human consumption”
Iowa, Hawaii, Vermont, Virginia, and Arizona all have kratom bills in the works, and as of the writing of this article the only states where kratom is controlled are Louisiana and Indiana.
